Hiring a lawyer is a big decision. Whether you’re dealing with a dispute, a business issue, or a personal legal matter, the lawyer you choose — and how they charge — can have a major impact on your outcome and your wallet.

At Law in Check, many of the overcharging disputes we see could have been avoided if certain warning signs were spotted early. Knowing these red flags at the start of a new matter can help you avoid unnecessary costs, frustration, and billing disputes down the track.

1. No Written Costs Agreement Upfront

One of the biggest red flags is being asked to proceed without a written costs agreement.

Before work begins, your lawyer should provide clear written disclosure covering:

  • How they charge
  • Their hourly rates
  • Likely total costs
  • Expected disbursements

  • If you’re told “we’ll sort the costs later,” stop and ask for proper disclosure. Verbal assurances aren’t enough.

    2. Vague or Unrealistically Low Cost Estimates

    An estimate that sounds too good to be true usually is.

    • The estimate is a single figure with no explanation
    • There’s no discussion of risks or variables

              If your agreement allows multiple lawyers to bill for internal discussions without limits, that’s a common source of inflated bills.

              Ask:

              • Who will work on your matter
              • When internal meetings are necessary
              • Whether junior staff can handle routine tasks
              • Efficiency matters — and you shouldn’t pay for unnecessary duplication.

                8. Resistance to Itemised Billing

                You have the right to request an itemised bill.

                If a lawyer:

                • Pushes back on itemised invoices
                • Uses block billing or vague time entries
                • Can’t explain how time was spent
                • …it may indicate billing practices worth questioning.
